Looks pretty simple to me. Heineken was simply trying to block purple kite from clearly over taking leader(Heineken's Buddy). Purple kite had better angle and could clearly pinched leader off course. Heineken should have ran his own race and really should have been dsq'd. Props to purple kite rider for video!

I disagree that the purple kite altered their course and violated Rule 16. But different people see different things, and I can understand how somebody would make that call.
The bigger issue here is that the Orange kite is failing to keep clear. For me, the first foul happens at time 0:33, the second at 0:49. At this point, the orange kite is not keeping clear based on the definition,
"One kiteboard keeps clear of another if the other can sail her course with no need to take avoiding action and, when the kiteboards are overlapped on the same tack, if the leeward kiteboard can change course in both directions without immediately making contact with the windward kite- board."
You also had mentioned "proper course", but I don't see how that has any bearing on this situation.
so I would say again that the orange kite gets the flag for breaking rule 11, and it is possible for the purple kite to get flagged for breaking rule 16...but I doubt it.

totally agree that it is a minor foul, and in fact the purple kite (not me) didn't file a protest for this.

I am interested in how sailors view these situations. I think it is pretty interesting that you can have a rider clear astern of you with their kite overlapped with yours.
I also want feedback from sailors/kiters regarding any changes to the rules that they think would work better.

My point if the "foul" didn't effect your race then why would you even care? Looks like da kine might owe you one Cubie at the bar or maybe a sprunch?

It looks like the purple kite (Patrick's I assume?) was in the same relative position as the free and clear, "proper course" kiteboard with the Ozone to leeward and ahead. When the purple kiter was getting rolled by the orange kite, the purple kite changed its position, raising it to tap the burdened passing rider's kite.

You are correct, Rule 11 gives you right of way: "When kiteboards are on the same tack and overlapped, a windward kiteboard shall keep clear of a leeward kiteboard". However, Part 2 Sec B rule 16.1: "When a right of way kiteboard changes course or the position of her kite, she shall give the other kiteboard room to keep clear." In other words you can't keep changing your kite position to tap someone out who is passing to weather and attempting to keep clear. You should remain on your "proper course" and proper kite position as you would in the absence of another kiteboard.
Good news is that the purple right of way kite that raised the position of their kite won't be penalized per rule 14(b): "A kiteboard shall avoid contact with another kiteboard if reasonably possible. However, a right of way kiteboard or one entitled to room or mark room; (b) shall not be penalized under this rule unless ther is contact that causes damage or injury."

respectfully disagree, here the orange kite is required to keep clear via Rule 11 and fails to do so. The purple kite does not make any substantial course changes so I do not think he violates Rule 16.

the point "did this effect your race in any way" is irrelevant. The rules are the rules, and keeping clear is keeping clear.
Orange kite gets the red flag if I were making the call.

Didn't bother to look up the rules cause the incdent seemed like a non issue. Did this effect your race in any way? Looked like you were getting rolled! Non foul just a little too much butter on that roll.
