Yes but if they gained a significant advantage then 10 points are added to their score. 1+2+3+10=16 > 4+5+6=15

It doesn't matter who a penalty is on.
If a boat is penalized after a protest hearing they will add 6 points to that teams score.

In This case blue finished in a 1-2-5.
1+2+5+6 =14 = BLUE
RED finisehd in a 3-4-6
3+4+6 = 13 = RED
RED < BLUE
Red wins in this situation
A team can be penalized and still win a race with 1-2-3 or 1-2-4 combination.
